Welcome to SAT Climb. These Terms of Service (“Terms”) form a legal agreement between you and NudgeLearn LLC (“SAT Climb,” “we,” “us”) when you use the SAT Climb website, mobile applications, and related services (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms.
1. Agreement to terms
Read these Terms carefully. They include important provisions about billing, automatic renewal, limitations on our liability, and dispute resolution. If you do not agree, do not use the Service.
We may update these Terms from time to time. We’ll post the revised Terms at this URL and update the “Last updated” date above. Material changes will be announced by email or in-product notice at least 14 days before they take effect. Continued use after the effective date means you accept the revised Terms.
2. Eligibility & accounts
Minimum age. You must be at least 13 years old to use the Service. If you are 13 to 17, you may only use the Service with the verifiable consent of a parent or legal guardian, who must accept these Terms on your behalf. By creating an account for a minor, the parent or guardian represents that they have authority to bind the minor to these Terms.
No users under 13. The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it. See the Privacy Policy for our COPPA practices.
Account responsibility. Sign-in is passwordless — you access your account with a one-time link sent to your email or by signing in with Google. You are responsible for keeping that email account secure and for all activity under your SAT Climb account. Notify us immediately at support@satclimb.com if you suspect unauthorized use.
One account per person. Accounts are personal and non-transferable. Do not share your account or sell access.
3. Subscriptions & billing
SAT Climb is offered as a recurring paid subscription in three durations, with a free tier for previewing the product.
- Free tier. Limited to 5 practice problems per day, with access to the adaptive daily plan and full Grid view. See our tier table for details.
- Weekly subscription — $25.00 USD per week, billed in advance and renewing automatically each week until canceled.
- Monthly subscription — $60.00 USD per month, billed in advance and renewing automatically each month until canceled.
- 3-month subscription — $120.00 USD per 90-day period, billed in advance and renewing automatically every 90 days until canceled.
Prices are listed in U.S. dollars and exclude any applicable taxes, which we will collect and remit as required by law. Payment is processed by our payment processor, Stripe; we do not store full payment-card details on our servers. Your purchase is also subject to Stripe’s end-user terms.
Plan changes. You can switch between paid plans at any time from your account settings. Switches take effect at the start of the next billing cycle unless otherwise indicated.
4. Cancellation & auto-renewal
All paid plans renew automatically at the end of their billing period (every 7 days for Weekly, every month for Monthly, every 90 days for 3-month) at the then-current price. You can cancel at any time from your account settings; cancellation takes effect at the end of your current paid period, and you keep access until then.
If we change the price of a subscription, we will give you at least 30 days’ notice by email before the new price applies to your next renewal. If you do not agree to the new price, you can cancel before the next renewal.
5. Refunds
Refunds are governed by our Refund Policy. In summary: all paid plans (Weekly, Monthly, 3-month) are non-refundable for the current billing period, but you can cancel auto-renewal at any time and your access continues through the period you’ve already paid for.
6. Acceptable use
You agree not to, and not to attempt to:
- copy, scrape, download, distribute, sell, or otherwise misuse any items, rationales, or other content from the Service, except for your own personal study;
- use automated tools, bots, or scripts to access or interact with the Service;
- reverse engineer, decompile, or attempt to extract the source code or model behavior of the Service;
- share your account, sublicense access, or use the Service on behalf of another person or organization;
- interfere with the Service’s security or normal operation (including bypassing daily question caps), or upload malicious code;
- use the Service to harass, defraud, or harm others, or for any unlawful purpose;
- impersonate another person or misrepresent your affiliation with any person or entity.
We may suspend or terminate accounts that violate these rules and may retain or share usage logs as needed to investigate misuse or comply with law.
7. Your license to use SAT Climb
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal, non-commercial SAT preparation. No other rights are granted by implication or otherwise.
8. Intellectual property
Our content. The Service and all of its content — software, designs, text, graphics, items, rationales, drill plans, scoring models, mastery models, and other materials — are owned by SAT Climb or its licensors and are protected by intellectual-property laws. Except for the limited license above, we reserve all rights.
Trademarks and disclaimers. SAT® is a registered trademark of College Board. SAT Climb is not affiliated with, sponsored by, or endorsed by College Board. Bluebook™ is a trademark of College Board, used here only descriptively to refer to the official testing application. Desmos® is a registered trademark of Desmos Studio PBC, referenced here only descriptively. All other trademarks are the property of their respective owners.
DMCA / copyright complaints. If you believe content on the Service infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to support@satclimb.com with DMCA in the subject line. Include your contact info, the copyrighted work, the location of the alleged infringement, a statement of good-faith belief, a statement under penalty of perjury that your notice is accurate, and your signature.
9. User content
You may submit content to the Service, including your answers to practice questions, feedback, free-text notes, and support messages (“User Content”). You retain ownership of your User Content. You grant SAT Climb a worldwide, royalty-free, non-exclusive license to host, store, process, display, and use User Content for the purpose of operating and improving the Service.
We may use aggregated and de-identified User Content to improve item difficulty calibration, mastery models, and other product features. We will not publish your individual responses with personally identifiable information attached.
10. Third-party services
The Service integrates with third-party services we rely on to operate. Your use of those services is subject to their own terms and privacy policies. Current third parties include:
- Stripe — payment processing. stripe.com/legal
- Railway — hosting and infrastructure.
- Resend — transactional and product email delivery.
- PostHog — product analytics. See our Privacy Policy for details.
Adding, removing, or changing these providers does not by itself require re-acceptance of these Terms.
11. Disclaimers
Educational tool, not a guarantee. The Service is an educational product. We make no representation or warranty that using SAT Climb will produce any specific SAT score, score improvement, college admission, scholarship outcome, or other result. Score projections are statistical estimates based on simulated performance and are not guarantees.
“As is” basis. To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of content, and uninterrupted availability.
12. Limitation of liability
To the fullest extent permitted by law, SAT Climb and its officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, or test-score outcomes, arising out of or related to the Service, even if advised of the possibility of such damages.
Our total cumulative liability for any claim arising from or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) $100.00 USD.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless SAT Climb from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of your breach of these Terms, your User Content, or your misuse of the Service.
14. Termination
You may cancel your subscription and stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or for legal or security reasons. On termination, sections 8, 9, 11, 12, 13, and 15 survive.
15. Governing law & disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflicts-of-law principles. Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in New Jersey, except that either party may bring an action in small-claims court for qualifying disputes.
Class-action waiver. You and SAT Climb agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
Opt-out. You may opt out of arbitration within 30 days of accepting these Terms by emailing support@satclimb.com with ARBITRATION OPT-OUT in the subject line and your account email in the body.
16. Changes to these terms
We may modify these Terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page and, for material changes, give you notice as described in Section 1.
